- The new hospital price transparency rule is CMS’ boldest effort to improve price transparency in the health care market place.
- The rule was opposed by stakeholders and was recently upheld by Judge Nichols. However, the AHA has appealed the effective date of January 1, 2021, citing reduced capital and limited staff bandwidth due to the pandemic.
- Providers and payers will be most effected by the ruling. However, the full extent of the externalities can only be postulated. It is unclear if CMS’ intentions to solve the affordability problem will be realized.
